Terms of Use
These terms of use (the "Terms") govern access to and use of the Eraika website (the "Site"), a free gift-idea suggestion service. Using the Site implies full and unconditional acceptance of these Terms. For information about the Site's publisher, see the legal notice.
1. Purpose and description of the service
The Site provides a gift idea generator: based on a few questions (occasion, recipient's profile, budget, interests...), the Site suggests a selection of products from third-party merchant catalogues. No sale takes place on the Site: purchases are made directly on the relevant merchant's site, outside of Eraika.
Without requiring an account, the Site also lets users temporarily keep (via cookies) a search history and a list of gift ideas, and provides contact and partnership request forms.
2. Access to the service
Access to the Site is free and does not require creating an account. Eraika strives to keep the Site accessible but does not guarantee continuous availability or the absence of errors or interruptions, in particular for maintenance reasons. The Site may be modified, suspended or discontinued at any time, without notice, without Eraika's liability being engaged.
3. User obligations
By using the Site, the user agrees to:
- use the Site strictly for personal purposes and in accordance with the law;
- not disrupt the Site's operation, in particular through automated means (scripts, bots, bulk data extraction) or an abnormally high number of requests (the Site's forms enforce a submission rate limit precisely to guard against this);
- provide accurate and up-to-date information in the Site's forms;
- not attempt to compromise the security or integrity of the Site.
4. AI-generated ideas
Some suggestions shown on the Site are selected or ranked using an artificial intelligence system, based on the criteria provided by the user. These suggestions are for guidance only and do not constitute personalised advice: Eraika does not guarantee their absolute relevance, nor the accuracy of associated product information (price, availability, description), which remains the responsibility of third-party merchants.
5. Links, third-party content and affiliation
The Site contains links to third-party merchant sites, including affiliate links (such as the Amazon Associates Programme). Eraika has no control over these third-party sites and disclaims all responsibility for their content, prices, availability or practices. Only the merchant's own site is authoritative at the time of purchase.
6. Contact and partnership forms
Information submitted through the "Contact us" and "Become a partner" forms is used solely to process the user's request, as described in the privacy policy. All fields in these forms are required; the information provided must be accurate.
7. Intellectual property
All elements of the Site (text, layout, logo, structure, code) are protected under intellectual property law, as detailed in the legal notice. Any unauthorised reproduction is prohibited.
8. Limitation of liability
Eraika strives to provide reliable information, without guaranteeing the accuracy, completeness or currency of the content shown (in particular content from third-party merchants). Eraika shall not be held liable for direct or indirect damages resulting from use of the Site, unavailability of the service, or use of third-party sites accessible from the Site.
9. Changes to these Terms
Eraika may amend these Terms at any time, in particular to reflect changes to the Site or applicable regulations. The version in force at the time of use of the Site applies.
10. Governing law
These Terms are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the French courts.
